When we compare these two malware type of programs, adware do not collect and upload invisibly this activity record and personal information when the computer user has not anticipate or authorize the transfer. Anyhow, some adware merchants insisting that their program who does this, is not a spyware, thanks to the disclosure of the software occurrences. For example: a product vendor could indicate that since somewhere in the product's Terms of Use there is a clause to agree that third-party software will be included that may collect and/or may report on the computer use, that this Terms of Use disclosure means the product is just adware. Adware has been criticized because it usually includes code that tracks a user's personal information and passes it on to third parties, without the user's authorization or knowledge.
